Welcome to Trigger Message. These Terms and Conditions (“Terms”) govern your access to and use of the Trigger Message platform, including all recognition services, messaging tools, integrations, dashboards, and related content (“Services”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree, you must not use the Services.


1. DEFINITIONS

For clarity in this document:

  • “Trigger Message”, “we”, “us”, “our” refers to Trigger Message (Pty) Ltd, a South African registered entity.

  • “User”, “you”, “your” refers to the business or individual accessing or using our Services.

  • “Platform” refers to the Trigger Message cloud dashboard, recognition system, APIs, messaging integrations, and any software provided.

  • “Recognitions” refers to events generated by cameras connected to our platform, including Licence Plate Recognition (LPR/ANPR) and Facial Recognition.

  • “Modules” refers to optional add-on features.

  • “Customer Data” includes personal information processed through the system.

  • “POPIA” refers to the Protection of Personal Information Act, 2013.


2. BUSINESS PURPOSE OF THE SERVICE

Trigger Message provides a cloud-based recognition and notification platform that allows businesses to:

  • Detect vehicles and/or faces in real time

  • Trigger notifications and actions (WhatsApp, Email, Telegram and onsite systems)

  • Run security alerts, compliance checks and daily reports

  • View analytics and business intelligence insights

Trigger Message is not a security company, nor does it replace physical security or access-control systems. We provide software intelligence only.


3. ACCEPTANCE OF TERMS

By using the Platform you confirm that:

  • You are authorised to enter into this agreement on behalf of your business

  • You will use the Services in accordance with POPIA and all applicable South African laws

  • You understand that the accuracy of recognition technology is high but not infallible, and must be used responsibly


4. SERVICE REQUIREMENTS

To use Trigger Message, you require:

  • A stable internet connection

  • Compatible CCTV or LPR/Face Recognition hardware, or Hikvision hardware supplied by us

  • Approved access to the administrative dashboard

  • Correct configuration of cameras, angles and lighting

We are not responsible for poor performance caused by incorrect installation, poor camera quality, or environmental factors.


5. LICENCE TO USE THE PLATFORM

Trigger Message grants you a non-exclusive, non-transferable, revocable licence to use the Platform for your internal business purposes only.

You may not:

  • Copy, modify or reverse-engineer any part of the software

  • Resell, lease or distribute the Platform to third parties

  • Use the Platform for unlawful surveillance or discrimination

  • Use recognition data for purposes not disclosed to your data subjects


6. SUBSCRIPTIONS, FEES & BILLING

All Services operate on a monthly subscription model.

6.1 Pricing Structure

Pricing includes:

  • A base platform fee

  • Per-camera/per-site fees

  • Optional modules (charged additionally)

You agree to the pricing displayed on the /pricing page at the time of subscription unless otherwise agreed in writing.

6.2 Billing

  • All fees are billed monthly in advance.

  • Invoices are payable within 7 days.

  • Late or unpaid accounts may be paused until payment is received.

6.3 Changes to Fees

We may update pricing with 30 days’ written notice.


7. SETUP, SUPPORT & MAINTENANCE

7.1 Installation

Trigger Message does not install hardware unless explicitly included in a signed agreement.

Where third-party installers are used, Trigger Message is not liable for workmanship or installation quality.

7.2 Support

Response times may vary depending on urgency.

7.3 Service Availability

We aim for 99% uptime, excluding:

  • Scheduled maintenance

  • ISP failures

  • Hardware failures

  • Force majeure events


8. DATA PROTECTION & POPIA COMPLIANCE

Trigger Message is built to support POPIA-aligned processing.

Your organisation, as the data controller (responsible party), remains accountable for lawful data collection, signage, consent and notices.

8.1 Data Roles

  • You are the Responsible Party.

  • Trigger Message acts as your Operator (service provider).

8.2 Your Responsibilities

You must:

  • Inform data subjects (via signage or policy) that LPR/Facial Recognition is used

  • Ensure lawful grounds for processing

  • Define retention periods

  • Ensure camera placement complies with SA surveillance laws

  • Obtain consent where legally required

8.3 Our Responsibilities

We:

  • Process data only on your instruction

  • Store data securely with encryption

  • Restrict staff access on a need-to-know basis

  • Maintain commercially reasonable security practices

  • Provide a Data Processing Agreement (DPA) on request

8.4 Data Retention

Retention settings are configurable within the Platform.

We do not retain data beyond the period agreed with you.


9. ACCURACY OF RECOGNITIONS

Recognition technologies are highly accurate but not perfect.

You acknowledge that:

  • False positives or false negatives may occur

  • Recognition should not be used as the sole basis for punitive action

  • The customer assumes all responsibility for operational decisions based on recognitions

Trigger Message is not liable for actions taken by your staff based on recognition events.


10. THIRD-PARTY INTEGRATIONS

Our platform integrates with:

  • WhatsApp (Meta)

  • Telegram

  • Email providers

  • Hikvision hardware

  • Your existing CCTV/LPR systems

We are not responsible for outages, changes or limitations imposed by these third parties.


11. INTELLECTUAL PROPERTY

All intellectual property related to the Platform, dashboards, modules, software, trademarks and material remains the exclusive property of Trigger Message.

Nothing in these Terms transfers ownership to you.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law:

  • Trigger Message is not liable for indirect, consequential or punitive damages

  • We do not indemnify you for legal claims arising from your unlawful data processing

  • Our total liability is limited to one month’s subscription fee

You agree to use the Platform responsibly and in accordance with law.


13. SUSPENSION OR TERMINATION

We may suspend or terminate access if:

  • Fees are unpaid

  • You breach these Terms

  • You misuse recognition data

  • You engage in unlawful activity

You may terminate the subscription at any time with 30 days’ notice.

No refunds are provided for partial months.


14. GOVERNING LAW

These Terms are governed by the laws of South Africa.

Any disputes will be resolved in the applicable South African court with jurisdiction over Johannesburg.
